it's sort of disingenous, under the circumstances, with the "loophole" available, it was sort of a fine response and the guy should accept that. The gist of the question was that she thinks the guy is making too much of this and I think she should be apologizing. I get why she did it, I just don't think it was the right thing to do and falling back on the technical justification is just silly. This isn't a court of law, it's a relationship.
