I don't know, but I asked because I frequently cannot start 360 games without doing an update.

I'd never considered what would happen if I were unable to download them.
Responses:
I presume there is a seperate class of games that "phone home" DRM style that still could be called a patch loader.

I think there are 2-3 games that do require the PSN for the DRM and are thus unplayable now. -- nm

I would expect that if it couldn't connect to the patch server it would assume there was no new patch.
