Clearly, IANAL, but every wedding party and every wedding photographer knows that the photography service has to include picture of key events.

If a photographer were to put in the little disclaimer and then be a lazy oaf (not saying that's the case here), I don't think the disclaimer should bar the couple from seeking damages to cover something they can never get: pictures of their wedding.
