Tri-Star had the rights since around 1997.

If they sold them, or part of them, to Heigl's production company, they weren't interested in making a good movie. And they especially weren't interested in starting a franchise.
Also, it looks to me that Abishag is mainly a way for Heigl to get her and her mom executive producer credits (and paychecks).
