So slight chance SCOTUS won't take it. But if they do, what will the question be?

It sounds like the question won't be: "Does the Constitution give marriage rights to gays" thus avoiding have to answer that question

But rather the question would be something like "Did the approach Prop 8 took in removing rights from a group violate the Constitution" thus basically only impacting the future of Prop 8 and potentially any other state that tries to overturn legislative gay marriage by voter referendum?

(Am I even close here?)
