I can't speak for kilbo, but my impression is that he's responding to znu's posts of "you can capture someone who isn't AQ, who meets AQ while in your custody, then becomes AQ after release" (admittedly TWuG's summary of znu's position) with "there's something wrong about imprisoning someone, putting them in Guantanamo and then telling the prisoner years later that 'turns out you were innocent, but we can't let you go because even though you weren't AQ then you probably are now'"
