With all due respect, you might want to recheck your next to last sentence.

There have been too many people privately and publically released for that to be true. One of the most egregious cases were the 3 British nationals released a few months ago--they were not picked up during combat of any sort.

The last prisoner accounting I read estimated that perhaps 10-15% were "bad guys", 10-20% innocent of any wrong doing, and rest were questionable. There is already a team of lawyers looking at each case and evaluating it. I think the end result will be a group apologized to and released, a group convicted of various crimes and sent to prison for life and another group that will be sentenced to anything from house arrest and probation to a couple of years in a federal facility.
