The beak doesn't look right to me but it's tough pic to go by.

The blue highlights throw things off a bit but I don't think it's a kestrel.
I'd say Merlin but at this point I'd call it all three we've narrowed it down to and see if someone corrects you on Flickr.
There's a Birds of Prey in NYC group on Flickr that might be able to help you.
