Because it's illegal to promote the car as having better fuel mileage than the EPA testing says it does.

For instance, on the older diesels, they were rated 40ish on the highway but if you weren't an idiot you can easily get 50mpg out of them.
You can't do that as much now with all of the emissions equipment on them but VW couldn't say "hey, you can get 50 on these without really trying" because the EPA said 40.
