An email list I'm on discussed this at length. The decision seems to hinge on the Judge not filing the verdict on the two charges of acquittal, but,

instead calling a mistrial on the whole proceedings.
The discussion was over whether the jury reading their verdict in open court should have been given the weight of an acquittal even without the judge recording it as such.
