one being: if this intern weren't present to do the work, would you hire someone to do it? the other being: the intern must benefit more than the employer, and the employer can't take immediate benefit from the internship.
That's kind of nebulous, but it's really intended to be an educational/training guideline, and being a gopher is not that.
