reading between the lines - I think Progressive was not hoping for the 1% rule to be enforced ( and it wasn't) - they were hoping for a lower value than the family wanted them to pay.
joke is on Progressive - $ 760k is not a small award. And if I am reading between Progressive's lines - I bet they try to negotiate that down with the parents -
its a nasty business.
