getting a divorce years ago....

This couple was issued a marriage license by the state which they both live. Turns out one of them was still married. Apparently the former spouse showed up at the wedding to let him know that he was still married. Now the pseudo bride does not want the marriage license to be mailed in because that would cause legal problems for the would have been husband. Should the officiant turn it in anyway because the ceremony was performed? or should the officiant not turn it in now that they have knowledge that some level of fraud has occurred. It appears that the fraud was not on the part of the two parties that participated in the wedding but the former spouse committed the fraud because they did not file the divorce papers as they allege was done years ago.
