This wouldn't be the first time this case was at the 8th Circuit.

It was thrown out once and the 8th Circuit reinstated it to decide the question of fact if he was starving.
We found out later, this isn't the prisoner's first try at living conditions.

The judge didn't think that the lawyer would appeal.

The evidence was inconclusive as to whether he ate the meat and he didn't lose any weight while at that jail.
