The question of fact is whether he lost 16 pounds or gained 4 pounds during his 13 month stay at the County facility. His documented weight went up 4 pounds but he claimed he lost 17 pounds in his first 3 weeks (before he was weighed) because he didn't eat anything due to the meat.

He filed 113 sick calls and grievances during his stay. On some, he noted that the meat was giving him stomach pains and that he could eat turkey. He also claimed he didn't eat for three months and lost only 2 pounds during that time.
