as mara said, if he volunteered (this time) to pose with the gun to his head (after drinking), then there is a case.
it's not always posthumous. if you remove yourself from the gene pool by making yourself incapable of reproducing, then you can live but still get the award.
mel is arguing that because she will likely be behind bars during her reproductive years, she should be eligible. however, as unlikely as it might be, she could still get knocked up, so she is not eligible.
