It is an inexact science to be sure, but the judge should be making a reasoned decision to issue the order in the first place. I've suggested the

possibility of a waiting period. From my perspective it's a balancing of the relative harms. The potential harm to the person who gets a valid protective order is obvious and has happened repeatedly. It's also potentially irreversible. The same is not true for the person handing over his/her gun. The odds are exceptionally low that he will suffer irreperable harm from that. So balance the risks, it's an appropriate position to take away the gun.
