It's not illegal to procreate with someone who is not your spouse, it's not an obligation to marry someone you get pregnant or remarry if a spouse dies leaving a kid with only one parent, adopting/guardianship of someone you didn't birth is legal and unrelated to marriage... I just can't see the justices buying that line of defense.
