There are laws where Obama can ask the DOJ to de-prioritize enforcement. Marijuana laws are one of those the DOJ isn't

DOMA, though, is a bit different in that Obama can't ask the IRS to recognize SS couples from states with SSM without going against the law.
No prosecuting is akin to ignoring the law.
Having the IRS recognize SS couples is actually violating the law.
