they can question someone without Mirandizing someone even if there is no public threat but the question could result in information being developed related to ongoing terror plots...
I'm paraphrasing wildly and will let the lawyers spot if I've grossly misstated anything but I think I'm close. I was all in favor of questioning this kid without miranda while there was a public threat but now that that's gone *and* Holder has expanded the loophole I'm against it.
I'm glad he'll be tried in a civilian court.
