We all agree there's a line between picking up a willing participant at the bar and rolling a passed out girl at a party over to take advantage.

But no-one can definitively say where the judgment line ends and the drinks take over. Same probably could be argued with the drunk driver somewhat. (Or have we just set the alcohol tolerances so low there that there's no way to argue that you lose judgment before going over?)
