My issue is that they were on the fourth floor. He didn't just walk past a ground floor apartment with their shades up.

He used a telephoto lens to shoot a family four stories up. People on the ground floor expect or should expect that people walking by can and will look in their windows. But if you live on the fourth floor you don't expect people to be able to see in to your apartment unless they live directly across from you.
It seem like what he's doing is different than taking a photo of someone out on the street. He's basically going into their apartment and photographing them.
This is my initial reaction and after more thought I may feel differently. But right now it feels like an invasion of their privacy.
