They're not breaking the law in every case. If you're arrested they take your DNA. People get arrested for things they didn't do all the time.

Why should they have their DNA taken if they've done nothing wrong?
Also, the answer is never don't do something and you won't have to worry. We should all be okay living in a police state since we don't commit crimes? I don't think so.
