I guess this is a legal question: so, my good friend's husband is an alcoholic. Last month she kicked him out, saying he wasn't allowed back home

until he went to rehab. He did go, although their insurance company would only allow a week's stay. (If he had been uninsured, the state would have covered a 28 day stay. This bothers me, but I digress...)
He stayed sober for a few weeks, but now things are back to normal and worse than ever. Among other issues, he was arrested last week and charged with DUI.
While discussing with my friend if a longer rehab stay is possible, she said he could only be kept longer if he is "a harm to himself or others". Would a DUI qualify as such, or does that probably mean suicidal or violent towards others?
She is going to see if the public defender can ask for court mandated rehab rather than jail time (this is a repeat offense; he was charged back in 2008). But she doesn't even know if that's possible, or what may happen.
