Advice or suggestions appreciated - so, we live in a townhouse development here. It's a small court with maybe 30 townhouses. There is one idiot that

lives here that loves to set off fireworks. Every year, without fail, he stands outside of his parking space, in the middle of the court, and shoots off 5 or 6 fireworks per night. This usually goes on in the days before and after July 4th. (Sometimes there's a random night here or there, I figure he must find more laying around somewhere...) So he stands in the court, and shoots them off towards the playground area and the big grassy area right next to it. Every year we (us and the houses right next to us) find fireworks in random places in our yards - one year there was one in our front flower bed and one in our front yard. They're clearly not making it into the field. They're, in my opinion, dangerously close to the houses.
From a noise standpoint, this guy pisses off the parents who live in this court. There are a LOT of babies/toddlers/young children in this court, so setting them off at 9PM or 10PM does wake up sleeping kids. (and no, I don't think this is the same thing as playing a piano at 4 in the afternoon...heh) From a safety standpoint, setting off fireworks in the middle of a crowded area full of houses and cars is not safe at all. Also, I'm pretty sure what he's doing is illegal.
We've called the sheriff a few times, and I know we're not the only ones. But of course, by the time the cops get here, he's already done and back inside. Will went outside tonight to ask him to stop ("there's kids sleeping here") and he, of course, got all standoff-ish. "It's only 9PM; there's kids standing over there so they're not in bed; I only have 2 more to set off." OK, whatever dude.
Is this something that could be dealt with if we call and complain to the HOA? Or is this totally an issue for the sheriff, since it's not legal for him to be setting off the fireworks in the first place?
