Yeah, I can't find anything that clearly state non-compliant policies include not complying with the pre-existing condition requirement, but that

would certainly seem likely.

The page below uses the phrase "the only exception," which is why I'm not sure. "The only exception is for grandfathered individual health insurance plans--the kind you buy yourself, not through an employer. They do not have to cover pre-existing conditions."

Their definition of grandfathered is more than just "the kind you buy yourself" -- it has to have been created before 3-23-2010.
