It's protected from government ban, but it's not protected from other free speech.

I think the competitive process of free speech works well over the long-term.
I think the key issue is complexity. Not only is the world becoming more complex, but people are being asked to make more decisions for themselves, and take on more risks in doing so. It can get overwhelming.
So we come up with ways to simplify things - we come up with principles of how things should be done, and we follow brands that work (whether they are consumer brands, or political ones).
But this creates further problems - principles may sound great, but they are not always workable, especially where they compete with other simple principles. And believing in a brand is easily exploited by the people who own the brand - whether it's a company, or a political party.
