Ah...that's where you're right and wrong, Marvel has no qualms about recasting, they dumped Norton 8 weeks before shooting and dumped Terrance Howard.

granted those guys were B Listers to be sure...but the head of Marvel is a guy by the name of Irv Puelmutter. And he's a hardass when it comes to money. I mean he goes into trash bins and rips up pads of paper so he can have that instead of buying Post It notes.
He's notoriously cheap. If it came to a point where Downey's participation doesn't effect box office, he's gone. Downey right now is the only one with any clout over there, and rightfully so. They took a risk on him and he delivered big time. So he should be rewarded. But if there ever came a point where they wouldn't have to for out the $80 Million (what he made on Avengers) again, believe me they'll take it.
my pure speculation is that in Avengers 3, that's where we will see the Battle with Thanos. And that's where Downey will die. Except Tony Stark will come back after he's had corrective surgery (or something) and the part will be recast...
