Neither was he, but the cops arrested him and charged him with Careless Driving, leaving the scene of a crash and not wearing a seatbelt.

And they are.
I've been in cars in that situation and she did the right thing. That guy was a complete idiot.
In those conditions large trucks in the right lane make it very hard to drive under normal circumstances, in the rain it gets worse.. Changing lanes is tough. That idiot was driving too fast for conditions.
