1. Was the car insured? Even if the guy wasn't insured if he was using the car with the permission of the owner (ie it wasn't stolen) if the car has insurance it would be covered.

2. If the guy doesn't have insurance, do you reasonably think that you'll get anything from him?

3. You should have uninsured motorist on your policy that should cover stuff. Most states require it now, IIRC.
