I get the point that you're making, that civil jurisprudence has historically taken its cues from canon and religious law.

However, the fact that we are able to change them ourselves without needing to submit to religious authority means that we have moved further and further away from those roots.
So I would say while the precedent for civil law is derived from religious law, the inspiration for it comes from the need to meet the needs of its citizens.
