They are sending 1099 forms to people who i) signed up and got the 40,000 points and ii) then redeemed the points but iii) only for airline tickets.

It appears that the only way they can apply a value to the points is to correlate them to an airline ticket. So as long as you don't use your points, or use them for something other than an airline ticket, you don't get nailed. That, already, is a FAIL. A bigger FAIL is that they are calculating the value of the tickets including taxes... which the consumer paid!
