These photos weren't "put out there". The current belief is that the users had checked the box...

to upload images automatically to the cloud. When they deleted their phones, they had every reason to believe that the data was gone, not realizing that there was an additional backup online that was not secure.
At least, that's the last thing I read on the subject. The situation is fluid.
