It is unlikely that it would be enforceable. Courts don't like non-competes.

Of course that wouldn't keep Jimmy John's from threatening action and hourly workers might be afraid of the costs of litigation if they were to have to defend a claim.

That was pretty much the point of my IM, but if the worker takes the dare I would be shocked if JJ actually tried to enforce it. It's basically there
