I think if people are choosing to have arrangements where more than 2 people are viewed as parents, then it is on them to see that

they've made all the necessary legal arrangements to see that is recognized upon their death (or whatever other event that would involve the government).
Write a will using a lawyer. Make it clear who is and is not considered a guardian.
Unless I'm missing something from what you're trying to get at, it seems like the issue is people expecting courts to recognize unusual situations as routine and sort it out without guidance from some of the parties involved (either through death, illness, whatever).
If it's the courts refusing to recognize things even if it's all on paper, signed and agreed to by all parties, then lets see where the issue is in the courts/law and amend it.
