Without a will you do not have a choice as to how the assets are distributed. It's determined by law. A will allows you to allocate as you choose

Honestly I don't practice in this area so I don't know for sure. I belive it does because you still have to pay off your creditors before assets get

The community has an interest in ensuring that the will was legal. If I show up after Trump dies with a will that gives me everything, it's bad
