I don't think anyone has said he did anything inappropriate until that point, except not communicating well. -- (edited)

except the touching the car part, which is part of that.
it may have served him better to ask for the keys as he asked the driver to step out, if it's legal there. that's not uncommon in at least some places, and it offers a measure of protection against fleeing drivers.
