In theory, that's fine. But look at how many "convicted killers" have been freed in IL because they were innocent?

The guy in Texas whose kids were killed in the fire and he was executed for setting it based on total crap science. He would have crossed your line and he was completely innocent. (Cameron Todd Willingham if you want to look up the story)
I'm not willing to execute the innocent with the guilty.
