the only reason i can see the uncle winning is, he will say he wouldn't have given/lent them money if he didn't think they needed it and

with the proceeds of the house, he doesn't think that applies now. (and he'll say that's what he thought all along.)
but it does suck for your mom - she's got to deal with a lot at the moment.
