I guess. IMHO at worst the guy changed his mind and now wants his gift to be a loan. Since it was in the best case scenario a gift, if he wants it

back I think I'd give it back. It makes him not a great guy, but at worst your mom is no worse off than she started. I'd feel very differently about this if this was compensation for something, but at worst it's just being a jerk. I don't see it so much as taking advantage because it was something he didn't have to do in the first place and even in the worst case scenario he floated the money so your mom didn't have to while she settled the estate. She still got upside.
