There are many situations where I think that happens. This is a big enough deal where I think it gets to the CEO or upper management in some way.

Even if the CEO didn't have direct knowledge he bears the ultimate responsibility because he ultimately is responsible for a culture that would result in lower levels trying to hide the problem rather than bring it to his attention. There are many situations where I agree with you on this subject, but this isn't one of them.
