Marvel Comics owns them. Marvel Studios and Fox Studios share the characters...

but they aren't the in the same movie universe. In the Marvel Studio Universe there are no Mutants.
Fox Studios has all the mutants.
Because in the comics QUicksilver and SW were mutants Fox can use them, because they debuted in Avengers, Marvel Studios can use them. They are the only two characters like that.
While Universal STILL has the HUlk, they work with Marvel clearly.
