I think it has more to do with the fact that the reason for wanting to stay in Mexico is different for each of them. I don't think her return has

anything to do with her lawyers promising her no jail time since she has no say in her deportation or transportation to California and now Texas.
This is all being done by the courts and the cops. She's wanted on a felony and is being returned to the state where she committed that felony. I don't think her return was based on an agreed upon jail sentence.
He's getting to stay longer because the courts want to make sure he's not having his rights violated by being sent back. It's just to waste time as he'll be deported once his case is heard.
