I think Qale's point was that EA (the makers of Spore) didn't disclose their DRM prior to purchase.

And didn't provide prospective purchasers of the software with any notice that their DRM restrictions were out of the ordinary. Additionally, retailers refused to buy back copies of the software once the shrink-wrap was broken.
So, in essence, consumers weren't told what they were purchasing, and then weren't given the option not to purchase it.
That's a far cry from your "bunch of pissy computer dorks" characterization.
