I totally agree with EFF's position.


Policing your mark doesn't require attacking every single person who uses it inappropriately -- or lawfully. It's only in commercial contexts where the duty is required.

Like EFF said, use of marks in satire, political speech, or other First Amendment free speech stuff is perfectly okay. In fact, I advise my clients to send those folks letters of acknowledgment and support.
