I haven't done it but it's worth the shot anyway. Explain it was 1am and the agent never told you there'd be an up charge for it.

They substitute cars so often that it's not unreasonable to expect it was for their benefit not yours.

You may want to contact corporate first and tell them you haven't disputed the charge but know you can.

At least ding the hell out of the salesperson if they call to see how your transaction was.
