IANAL but yes - unless they are in prison for murdering the person who wrote the will.

As far as controlling the asset goes, I suppose it would be like control of any other asset they have - like their house or bank accounts or shares. People on the outside would manage them according to the owner's instructions.

If they have no next of kin, they should write a will themselves.
