He stated that she make an active choice of words.

I don't think you can tell her intent or motive -- if she had one -- without more information. In legal parlance, znu hasn't met his burden under the preponderance of evidence standard. Absent more information, it's just as likely that she was speaking from ignorance as any other explanation.
