I think that's largely irrelevant. It's still removing classified information from the government servers. No different than taking classified files

home to do work (also not permitted, but not prosecuted). Also, I'm not quite sure why being on a "public" server would be better since that would be putting classified information into the hands of a third party. Yes, I understand it might have tougher security protocols, but it's also probably easier to find and, as mentioned, is literally in the hands of a third party without clearance.
