Pretty much. It's a level 2 system, which makes it glorified cruise control.

The cars ship with it turned off and drivers are given explicit warning that they must remain alert, with hands on the wheel (sensors can tell if they aren't and will slow the car to a stop if that input is lacking).

The fatal accident appears to be the driver treating the system as if it were a level 4 (complete autonomy) and this one sounds like it'll end up being "I screwed up, I'll blame the car"
